Article 1: Visuals and Customer Responsibility

The customer is responsible for ensuring the quality of their files, particularly by making sure that the submitted images have sufficient resolution. When adding an image through the configurator, it is essential that the image remains sharp when the customer clicks the "Zoom" button. This zoom reflects the resolution of our printing systems. Therefore, if the image appears sharp at this stage, it will also be sharp in the final print. Conversely, if it appears blurry when zoomed in, this lack of sharpness will be reflected in the final result. It is the customer's responsibility to thoroughly check the sharpness of their images to guarantee optimal print quality.

Spelling mistakes, syntax errors, grammar errors, stylistic errors, centering issues, translation errors, or positioning issues in the texts or images uploaded by the customer fall under their sole responsibility. Validating the order implies approval of the files displayed on the website. The customer is responsible for verifying their files.

It is the customer’s responsibility to ensure that the printing of their cards complies with all applicable laws. The customer acknowledges owning the intellectual property rights of the uploaded visuals. If the customer includes specific game rules on their visuals, they acknowledge having verified the applicable legislation and accept full responsibility.

Scratcher emphasizes the obligation to comply with all applicable laws, excluding any offensive, discriminatory, or unethical content on the scratch card visuals. Elements such as violence, nudity, defamation, or any illegal content will be rejected. The prizes offered must also comply with legal and ethical standards. Scratcher reserves the right to refuse any order that violates these principles, thus ensuring the conformity of its products with social and legal standards.

It is strictly forbidden to have the cards printed by any entity other than Scratcher. The statement "Printed by ourselves" is also prohibited. By validating their order, the customer authorizes Scratcher to add the mention "Printed by Scratcher" on the cards, unless explicitly stated otherwise.

Article 2: Payment Terms

Full payment is required at the time of order confirmation. Accepted payment methods include bank cards and bank transfers. The order will be processed and the products reserved or manufactured once full payment has been received. In case of non-payment within the required timeframe, Scratcher reserves the right to suspend or cancel the order. All financial transactions are secure and processed in accordance with current security standards. No payment information is stored by Scratcher after the transaction. We do not respond to supplier form opening requests. In case of payment by bank transfer, a proforma invoice with the company’s bank details will be sent to the customer. The customer will make the payment and send a bank proof of transfer to initiate production while awaiting receipt. Chorus payment is applicable only to French public institutions, with a minimum order amount of €500 excluding VAT. The ordered products, considered "highly personalized," are not subject to a withdrawal period. Orders are final and non-refundable.

Article 3: Production and Delivery

Scratcher uses its best efforts, to the extent possible and except in cases of force majeure, to meet the production times indicated in real time on its website, depending on the quantities and formats chosen. Production times begin the next business day after full payment and final file validation.

The delivery times shown on our website are provided for information only by our carriers. These times may vary depending on several factors, such as the recipient’s location, their availability at delivery, weather conditions, and the carrier’s logistical constraints. By accepting these conditions, the customer acknowledges that delivery times are indicative and that any delay compared to these estimates cannot lead to a claim. We commit to informing the customer of any potential delays and taking appropriate measures to minimize the impact on final delivery.

Customers who order tickets for events with strict deadlines are advised to take all necessary precautions, considering the indicative delivery times provided. These times depend on external transport partners, and although we select reliable providers, we cannot guarantee absolute precision. It is therefore the customer’s responsibility to ensure that estimated delivery times are considered when planning the event. In case of doubt, we recommend placing the order with a sufficient safety margin to avoid any inconvenience caused by potential delays.

Hidden prize variations will be delivered according to the customer’s choice, either separately or mixed. Unique numbers can be added according to the customer’s specifications.

Scratcher does not offer white-label shipping. If the customer modifies the delivery instructions with the carrier outside of Scratcher, we decline all responsibility regarding parcel tracking and delivery.

Article 4: Quality

The customer has three days after receiving their package to submit any claims. No claim will be considered after this period.

It is important to note that the colorimetry of a new print may differ from previous print runs. It is recommended to place a single order if color consistency is important to the customer for a multi-batch print. Additionally, products must be protected from light and heat. The validity/expiration date applies if stored closed in their packaging at moderate temperature. The position of the scratch-off area may vary around the visual by +/- 2 mm on each side. It is the customer’s responsibility to adjust their visual accordingly, planning safety margins. If the light gray background supporting the hidden messages exceeds the scratch-off area, the tolerance has been exceeded. If the light gray background is not visible, the tolerance is met.

In the event of a dispute related to a clear printing defect, Scratcher commits to reprinting the affected cards.

The cards have a lifespan of 6 months after shipment. They must be stored in a dry place, protected from cold and heat, within a temperature range of 10°C to 30°C.

Article 5: Applicable Law and Jurisdiction

These General Terms and Conditions of Sale are governed by French law. Any dispute relating to the interpretation, execution, or termination of these conditions will be brought exclusively before the Commercial Court of Tours, referring to the Tours Trade and Companies Register (RCS). The parties expressly agree to submit to the jurisdiction of this court for any dispute related to these terms, thereby waiving any other potential competent forum or jurisdiction.

Any connection to the site is subject to compliance with these conditions.
